These Terms of Service (“Terms”) govern your use of the EVIM website located at evim.store and any purchase made through the website.

Throughout these Terms, “EVIM,” “we,” “us,” and “our” refer to EVIM LLC, a New York limited liability company.

By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms and to all policies incorporated into them, including our Shipping & Delivery Policy, Return and Refund Policy, and Privacy Policy.

If you do not agree with these Terms, you should not use the website or purchase products through EVIM.

1. EVIM Online Store

EVIM is an online retailer specializing in furniture, home décor, and related home products.

Products offered through EVIM may be sourced, processed, fulfilled, and shipped through a network of manufacturers, suppliers, distributors, warehouses, carriers, and fulfillment partners.

EVIM remains the retailer and customer-facing point of contact for orders placed through evim.store.

2. Eligibility to Use the Website

By using this website, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian to use the website.

You may not use our website or products for an unlawful or unauthorized purpose.

You may not attempt to interfere with the security, operation, functionality, or integrity of EVIM's website or systems.

3. Product Information

We make reasonable efforts to present product information accurately.

Product information may be based in part on information supplied by manufacturers, suppliers, distributors, or other third parties.

5. Measurements and Product Fit

Before purchasing furniture or oversized merchandise, you should measure the intended space as well as any:

EVIM is not responsible for an item failing to fit into a customer's property when the product dimensions displayed at the time of purchase were materially accurate.

6. Assembly and Installation

Some EVIM products may require assembly.

Assembly requirements will be displayed when the information is provided to us.

Unless specifically stated otherwise, EVIM does not provide:

Assembly
Installation
Wall mounting
In-home placement
Removal of existing furniture
Removal of packaging or debris

Customers are responsible for arranging any labor or professional assistance required to safely assemble, install, or position their purchase.

Products should be assembled and used according to manufacturer instructions.

7. Product Availability

Product availability may change without notice.

Because EVIM works with multiple suppliers and fulfillment locations, an item shown as available may occasionally become unavailable before fulfillment is completed.

An order confirmation does not guarantee inventory availability.

If a product becomes unavailable after you place an order, EVIM may:

Cancel the affected item and provide a refund, or
Offer an alternative product.

You are never required to accept a substitute.

8. Prices

Prices are listed in U.S. dollars unless otherwise stated.

EVIM may change product prices at any time before an order is placed.

A price change after you complete a valid purchase generally will not affect that completed purchase unless there was an obvious pricing or listing error.

Prices do not necessarily include applicable taxes or shipping charges unless expressly stated.

9. Pricing and Listing Errors

Despite our efforts, a product may occasionally be listed with an incorrect:

EVIM reserves the right to correct errors and, where permitted by law, cancel an affected order before fulfillment.

If EVIM cancels an order because of an error after payment has been collected, the amount paid for the cancelled item will be refunded.

10. Orders

Submitting an order constitutes an offer to purchase products from EVIM.

Receiving an automated order confirmation does not necessarily mean that your order has been finally accepted or fulfilled.

EVIM may review an order before fulfillment for matters including:

Product availability
Payment authorization
Suspected fraud
Address verification
Pricing errors
Product restrictions
Shipping limitations

EVIM may decline or cancel an order when reasonably necessary and permitted by law.

If we cancel a paid order, the appropriate refund will be issued.

This may apply to orders that appear to involve unauthorized resale, fraud, pricing errors, or unusual purchasing patterns.

You authorize EVIM and its payment-service providers to charge the amounts shown at checkout, including applicable:

Shipping costs
Taxes
Other charges disclosed before purchase

Payments may be processed through third-party payment processors.

EVIM does not directly store all payment-card information.

13. Taxes

Applicable sales taxes and other legally required transaction taxes may be collected based on factors such as the delivery destination and applicable law.

Taxes shown at checkout may be calculated through EVIM's ecommerce platform or other service providers.

14. Shipping and Fulfillment

Products may ship directly from third-party manufacturers, suppliers, distributors, warehouses, or fulfillment partners.

Shipping origin, carrier, packaging, processing time, tracking availability, and delivery method may vary.

Different items within the same order may ship separately.

EVIM is responsible for complying with its published shipping representations. Federal rules generally require online sellers to have a reasonable basis for stated shipping times and address qualifying shipment delays with the customer.

15. Delivery

Customers are responsible for providing accurate and complete delivery information.

EVIM may not be able to modify a shipping address after an order has entered processing.

Customers may be responsible for additional costs arising from customer-provided incorrect addresses, refused deliveries, unclaimed shipments, or failed delivery attempts when permitted by law and disclosed under our policies.

16. Returns and Refunds

Returns, cancellations, damaged-item claims, and refunds are governed by our Return and Refund Policy.

Customers should review the policy before making a purchase.

EVIM's return policy will identify applicable return periods, return conditions, customer return-shipping responsibilities, and any applicable fees. Shopify requires merchants to maintain clear, accessible refund information, and New York requires retailers to disclose their refund policy and applicable return fees.

Nothing in these Terms limits rights that cannot legally be waived.

17. Damaged, Defective, or Incorrect Products

If a product arrives damaged, defective, incomplete, or materially different from the item ordered, customers should contact EVIM promptly.

EVIM may require reasonable supporting documentation including:

Photographs of the product
Photographs of packaging
Photograph of the shipping label
Description of the issue
Order information

Customers should retain the merchandise and packaging until the claim has been reviewed.

Available remedies will depend on the circumstances and applicable law and may include replacement parts, replacement merchandise, repair, partial refund, full refund, or another appropriate remedy.

18. Third-Party Suppliers and Service Providers

EVIM may rely on third parties to provide:

Product manufacturing
Inventory
Warehousing
Fulfillment
Shipping
Payment processing
Website hosting
Analytics
Customer communications
Other business services

These relationships do not eliminate EVIM's obligations to customers under applicable consumer-protection laws. Shopify specifically notes that dropshipping merchants must comply with laws applicable to retailers of the products they sell.

EVIM does not control third-party websites and is not responsible for their independent content, policies, availability, security practices, or services.

You should review the terms and privacy policies of any third-party website you visit.

20. Intellectual Property

Unless otherwise stated, the EVIM website and EVIM-created materials are owned by or licensed to EVIM LLC.

This may include:

EVIM name and branding
Logos
Website layout
Original photographs
Graphics
Written content
Product curation
Marketing materials
Videos
Design elements

Third-party product photographs, trademarks, manufacturer names, and product materials remain the property of their respective owners where applicable.

Nothing on the website grants users the right to reproduce, distribute, modify, sell, or commercially exploit EVIM-owned materials without written permission.

21. Reviews and User Content

If you submit a review, photograph, comment, testimonial, or other content to EVIM, you represent that you have the right to submit it.

EVIM may remove user content when appropriate.

22. Prohibited Uses

Customers should stop using any product that appears damaged or unsafe.

Unless EVIM expressly provides a separate written warranty, EVIM does not create an additional manufacturer warranty merely by selling the product.

Nothing in these Terms excludes or limits any warranty or consumer protection that cannot legally be disclaimed.

EVIM does not guarantee that the website will always operate uninterrupted, error-free, or without temporary service interruptions.

Any disclaimer in these Terms applies only to the extent legally permitted and does not waive statutory consumer rights.

27. Limitation of Liability

To the maximum extent permitted by applicable law, EVIM LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of the website.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

This limitation does not relieve EVIM of responsibility for providing remedies required by law for defective, materially misrepresented, damaged, undelivered, or otherwise nonconforming merchandise.

28. Indemnification

To the extent permitted by law, you agree to indemnify and hold EVIM LLC harmless from third-party claims arising from your unlawful use of the website, violation of these Terms, infringement of another person's rights, or intentional misuse of EVIM services.

This provision does not apply to claims resulting from EVIM's own legally actionable conduct.

Your use of EVIM is also governed by our Privacy Policy.

EVIM may share information with service providers, payment processors, fulfillment partners, warehouses, carriers, and other businesses when reasonably necessary to process and fulfill orders or operate the store.

Changes apply prospectively unless applicable law permits otherwise.

The Terms applicable to a purchase generally will be those in effect when the order is placed.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

32. No Waiver

EVIM's failure to enforce a provision of these Terms does not constitute a permanent waiver of that provision.

33. Entire Agreement

These Terms, together with our applicable policies and any product-specific terms presented before purchase, constitute the agreement between EVIM and the customer regarding use of the store and applicable purchases.

34. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where the consumer protection laws of another jurisdiction must legally apply.

Nothing in these Terms deprives a consumer of mandatory protections available under applicable law.
